Loans - Ebayer hit with cars previous owners debts - 29/04/2008

A woman who bought a car on Ebay was shocked when bailiffs turned up at her house to repossess the car that she had just paid £24,000 for on the popular auction website.

Clare Gillas bought the car in April 2006 after becoming the highest bidder in the auction. However, due to a mix up between the seller, Jhalman Rai, 42 and loans company Logbook Loans, the car still had £63,000 worth of outstanding unpaid debt on it when Mrs Gillas came to own it.

After the bailiffs turned up on her drive at 3am in November 2006, Mrs Gallis launched a high court battle against Mr Rai. The case came to an end last Thursday, with Mrs Gillas victorious and Mr Rai fined for his ‘lack of business acumen.’

The car was returned to Mrs Gillas, with the loan company paying her court costs as well as paying 75% of Mr Rai’s court costs.

Mr Rai also paid £4,500 to Mrs Gillas for his mistake. Despite this Mrs Gillas says that she is not satisfied with the verdict and is considering taking the matter further.

“This whole process has been hugely stressful and I am still mega out of pocket by the whole thing. This shouldn’t cost me anything, but I’ve spent around £10,000 on the whole thing.”
